Terms of Service

Toyify turns a photo you upload into AI-generated images styled as collectible action figures. Every output is synthetic media created by artificial intelligence. The output is a digital image only — you are not purchasing a physical product, toy, or any real merchandise, and no physical item will be shipped. Toyify is independent and is not affiliated with, endorsed by, or associated with any toy company or brand; all figure styles are original designs.

You must be at least 18 years old to use the Service. By using it, you represent that you meet this requirement and that your use complies with all applicable laws.

By uploading a photo, you represent and warrant that:

• You are the person shown, or you have the explicit consent of every person shown;
• You own or have the rights necessary to upload and process the photo;
• The photo does not depict a minor and is not unlawful, obscene, or infringing.

You retain ownership of your original photo. You grant us a limited, temporary license to process it solely to provide the Service (including an automated safety check). We claim no ownership of your uploads and do not use them to train AI. Uploads are governed by our Acceptable Use Policy.

Uploads are screened by an automated safety filter before any image is generated, and unsafe or prohibited uploads are rejected. We may remove content, suspend access, and — where the law requires — preserve and report material (including reporting suspected child sexual abuse material to the relevant authorities). To report a violation or request removal, email help@toyify.app.

Subject to your payment and these Terms, you own the images you generate and may use them for personal and commercial purposes. Because outputs are AI-generated, they may not be eligible for copyright protection in some jurisdictions, and we make no guarantee about the intellectual-property status of any output. You are responsible for ensuring your use of an output does not infringe anyone’s rights.

All images produced by the Service are AI-generated and are labelled as such (including in the image metadata). You must not present them as genuine photographs, as real products, or as endorsements, and you must comply with any labelling obligations that apply where you share them.

Purchases are one-time payments processed by Stripe; there is no subscription. Prices are shown before purchase and may change. Digital content is generated on demand and delivered instantly. At checkout you expressly request immediate delivery and acknowledge that you thereby lose any statutory 14-day right of withdrawal for the delivered item (where such a right applies, e.g. for EU/UK consumers). Except as set out in our Refund Policy or as required by law (including for a genuine technical failure to deliver), sales are final. Nothing here limits mandatory consumer rights in your country of residence.

Results are produced by third-party AI and are inherently unpredictable. They may not perfectly resemble you, may contain errors or artifacts, and are provided for entertainment. We do not guarantee any particular quality, likeness, or outcome.

THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOYIFY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE PRIOR 3 MONTHS OR USD $20. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including mandatory consumer protections).

You agree to indemnify and hold OUTWORX FOR WEB-DESIGN and its owner harmless from any claims, damages, or costs arising from your uploads, your use of the Service, or your violation of these Terms — including claims by any person shown in a photo you uploaded.

These Terms are governed by the laws of the Emirate of Dubai, United Arab Emirates and the applicable federal laws of the United Arab Emirates, without regard to conflict-of-law rules, and the courts of Dubai have jurisdiction — except that if you are a consumer resident in the EU, UK, or another jurisdiction whose law gives you mandatory protections, you keep the benefit of those protections and may bring proceedings in your local courts. Where permitted, individual disputes may instead be resolved by binding arbitration, and to the extent enforceable, you and Toyify waive participation in any class action; this waiver does not apply where prohibited by law (including for many consumers). Consumer class-action and jury-trial waivers are not enforced against consumers where local law forbids them.

We may update these Terms; material changes will be reflected in the “Last updated” date and, for uploads, re-confirmed via the consent step. Continued use after changes means you accept them.
